MONTEREY BOARD OF HEALTH MEETING MINUTES

Date:  July 31, 2006

Present:  John Makuc, Nora Hayes, ACO, Peter Kolodziej, and Stephen Enoch (arrived at 3:54)

The meeting began at 3:47pm

·       Reviewed mail
·       We’ve had a couple of dog bites in town this weekend.  The dog and owner of one of the bites is from Sheffield, does Monterey’s ACO handle the quarantine or does Sheffield’s ACO handle it.  Peter K. informed the board that Monterey needs to notify Sheffield about the bite and referred Nora to speak with Mike Cahill about the best way to handle these situations.
·       Greg from New England Keswick came in regarding the bear situation they’ve been having.  It’s an approximately one year old bear roughly 100lbs that has been coming daily to the camp (a mother has not been seen with this bear).  They are installing a fence around the dumpsters and have purchased some air horns.  They wanted to make the issue known since it is a safety concern and asked for the board’s advice.  The Environmental Police were contacted but wouldn’t come out to the camp and said there was nothing they could do.  Division of Fisheries and Wildlife said they aren’t allowed to move the bear.  Peter suggested sending a letter directly to the Environmental Police with the issue and the actions taken and that the bear is still coming back and ask what the next step is, cc our local representative and the board.
·       The ACO appointment scenario was reviewed:  When the Board of Health needed to find an ACO they went to the Select Board to ask how they wanted to handle it, if they wanted to find one or delegate it to the Board of Health and the Select Board agreed to delegate the responsibility of finding one to the Board of Health and when they did the Select Board happily appointed Nora on 5/8/06 on the boards recommendation.  The issue has since escalated to Barbara Swann, Town Clerk 1st refusing to swear Nora in as the ACO as she did not think that the appointment was done properly, she has since agreed to swear Nora in but will not acknowledge her title as a legal and official town position.  She has told Nora that any citations she writes she will not honor and will tell anyone that comes in with them that they are illegal and invalid and do not need to be paid.  She also told Nora that she would not provide Nora with a list of unlicensed dogs in the area for her to follow up on.  She informed Nora that the only way to resolve this will be at the annual Town Meeting.  The board is going to seek advice from the Town Counsel as well as the Ethics Commission on how to go forward with this situation.  John is going to call and invite Barbara Swann to attend our next meeting on August 7th at 3:30 and will also contact Dale Duryea about the rumors that he wanted the ACO position even though he did not apply.
·       A letter from some concerned residents regarding the goose droppings on the beach was reviewed and the possibility of a health concern was discussed.  It has not become a public health issue to date and the Parks Commission is meeting on Wednesday to discuss some solutions.  The board did suggest using a decoy dog until a better solution can be reached.
·       The Application for Beaver Conflict Resolution Permit for Joan Roland on Cronk Rd was reviewed and the board decided that right now it is not a public health and safety issue.  Peter K. will make a site visit and report back to the board.
·       The Rothschild ZBA packet was reviewed and a letter was written to the board with it’s decision that it can not approve it at this time due to the proposed number of bedrooms and the number of bedrooms the septic was designed for.
·       Peter informed the board that Swann Lodge would not be opening this season.
